Trials, verdicts, and judgments

Cases tried to a jury or the bench, and contested matters resolved on dispositive motion.

  1. Defense verdict

    Defended a Florida t-shirt manufacturer against trademark fraud claims and won a defense verdict at jury trial — one of the first jury trials held in the Northern District of Texas after the pandemic.

  2. Affirmed on appeal

    Represented the Chapter 7 trustee of a Colorado private equity group in fraudulent transfer and alter ego litigation against its former control persons. After a two-week trial the bankruptcy court avoided the transfers and entered judgment against the insiders and their entities. The district court and the Tenth Circuit affirmed.

  3. $8.9 millionverdict; favorable settlement

    Represented a Dallas family against a California psychiatric facility. The other defendants settled; the carrier for the last one rejected a pre-trial demand inside policy limits. After a month-long jury trial the jury returned $8.9 million. The resulting failure-to-settle claim against the carrier was resolved by a favorable settlement.

  4. $5.5 millionsettled for investors

    Represented individual noteholders of a telecommunications company that defaulted on their notes. Settled the claims for principal and interest, then litigated the remaining claim for warrants in the Delaware Court of Chancery. Argued the fee appeal to the Delaware Supreme Court, sitting en banc, which reversed and held the noteholders entitled to their attorneys' fees.

  5. Settled before trial

    Defended the title company and closing agents — the majority of the defendants — in a $9.3 million mortgage fraud suit brought by the mortgage arm of a Forbes Global 500 bank. Took over discovery after the co-defendants settled, including the plaintiff's corporate representative depositions, and settled for $50,000 weeks before trial.

  6. Three-week jury trial

    Part of the trial team for a Texas technology company in a three-week jury trial in Los Angeles Superior Court against a major national airline and its in-flight connectivity vendor. The jury returned a verdict for the defense. The case was then carried to the California Court of Appeal by petition for writ and to the California Supreme Court by petition for review.

  7. Published opinion

    Represented a certified court reporter and her agency against the Texas Judicial Branch Certification Commission after the Commission dismissed their complaint about depositions taken by people who were not licensed court reporters and transcribed by artificial intelligence. Defeated the Commission’s plea to the jurisdiction on the mandamus claim and defended that ruling on appeal: the Third Court of Appeals held that reporters have a particularized interest in the enforcement of the rules governing their own profession, and the Supreme Court of Texas denied review. The court held separately that sovereign immunity was not waived as to the companion petition for judicial review. Judicial Branch Certification Comm’n v. Holmgren, 691 S.W.3d 155 (Tex. App.—Austin 2024, pet. denied).

  8. Three master-planned communities

    Represented one of the largest Dallas-based real estate developers as litigation counsel in a dispute with a national homebuilder spanning three master-planned communities.

  9. Multimillion-dollar recovery

    Represented an investor after two failed hotel projects, obtaining a settlement from certain defendants and judgments against others.

  10. Control secured

    Represented a large Latin American food exporter in a contest for corporate control.

  11. Dot-com wind-down

    Represented an investor in litigation against a failed internet company and its largest creditor, a major computer hardware manufacturer, on trade secret, securities fraud, and breach of contract claims.

Lender disputes, restructuring, and bankruptcy

Borrower- and guarantor-side work opposite secured lenders, receivers, and the FDIC.

  1. $15 millionloan dispute

    Represented the CEO and principal shareholder of a commodities firm against its senior secured lender. Defeated an involuntary bankruptcy petition on summary judgment, then settled the bad-faith claim on terms that effectively cancelled the debt.

  2. $28 millionthree loans restructured

    Represented the borrower and alleged guarantors on loans secured by commercial real estate in Fresno, California, working alongside outside bankruptcy counsel.

  3. $19.5 millionloan restructured

    Represented a Dallas REIT in restructuring a loan secured by a New Orleans office building.

  4. $12 millionloan

    Represented the bankrupt borrower and alleged guarantors on a loan secured by real property in Travis County, Texas.

    Represented a Dallas life insurance company after a failed loan participation in a Colorado development, once the FDIC took control of the lead bank.

    Represented a Dallas firm in a pre-litigation dispute with its senior lender, resulting in a favorable restructuring.

Intellectual property and technology

Patent and trademark litigation, licensing, and development agreements — informed by a forensic science degree, an IP LL.M., and a USPTO registration.

  1. Settled at mediation

    Lead counsel for a cosmetic device manufacturer in a multimillion-dollar patent infringement and unfair competition suit. Retained three months before trial; built the claim analysis and trial strategy, took and defended every deposition, and handled dispositive motions, claim construction briefing, and Daubert and Robinson challenges. Settled favorably the night before pretrial materials were due.

  2. Multi-vendor development

    Negotiated and drafted the agreement series for a complex software development project spanning several vendors, licensing of existing code, development of new code, and commercialization of the finished product.

  3. Oilfield technology license

    Drafted and negotiated a license between two large companies covering technology still in patent prosecution.

  4. Enterprise software license

    Negotiated a multimillion-dollar ERP license with a major software vendor, together with the related implementation agreement with a national consulting firm.

  5. Failed deployment

    Represented a major international physical commodities trader against a California software licensor over a failed modification and deployment project.

  6. Government-sponsored research

    Negotiated Cooperative Research and Development Agreements with the Department of Energy, Work for Others agreements with national laboratories, and consortium agreements with public and private universities. Prosecuted two patent waiver petitions to the United States government for inventions arising from federally sponsored research.

  7. Licensing and services programs

    Drafted and negotiated technology development, software licensing, and long-term services agreements, including geological and geophysical data licensing, acquisition, and processing agreements, and voice, data, and mobile services agreements with leading carriers.
